These Terms of Use (“Terms”) govern your access to and use of the Express Leads platform, services, websites, and related products (collectively, the “Services”).

By accessing or using our Services, you agree to be bound by these Terms and our Privacy Notice. If you do not agree, you must not use the Services.

These Terms constitute a binding agreement between you (“User”, “you”) and Lead Reach Limited, trading as Express Leads (“we”, “us”, or “our”).

3. Eligibility & Account Registration

To use our Services, you must:

  • Be at least 18 years of age and capable of entering into binding contracts.
  • Use the Services solely for business purposes (B2B). Consumer or personal use is not permitted.
  • Provide accurate, current, and complete information during registration.
  • Maintain the security of your account credentials and accept responsibility for activities under your account.

We reserve the right to suspend or terminate accounts if eligibility criteria are not met or if false information is provided.

4. Use of Services

You agree to use the Services only for lawful business purposes and in accordance with these Terms. Prohibited uses include (but are not limited to):

  • Using the Services for spam, harassment, or unlawful marketing practices.
  • Attempting to reverse engineer, copy, or resell the platform without written authorisation.
  • Accessing data in violation of privacy or data protection laws.
  • Interfering with or disrupting the security or integrity of the Services.

We may monitor usage for compliance and reserve the right to suspend or terminate access if prohibited activities are detected.

5. Subscriptions, Billing & Cancellation

Access to paid features of the Services is offered on a subscription basis. By starting a subscription, you authorise us (and our payment processors) to charge the applicable fees to your chosen payment method on a recurring basis until you cancel.

Unless otherwise required by law or expressly stated, fees are non-refundable. Certain statutory “cooling-off” rights may apply to consumers; however, our Services are intended for business use (B2B).

6. Free Trials & Promotions

We may offer a free trial to help you evaluate the Services (for example, a 5-day trial with up to 500 prospect exports). Trial features, limits, and eligibility may vary and are disclosed at sign-up.

  • Fair use: We may apply technical limits and monitoring to protect platform integrity during trials.
  • Conversion: At the end of the trial, continued access to paid features requires selecting a subscription and providing billing details.
  • Termination: We may end or modify a trial at any time for abuse, misrepresentation, or platform protection.
  • One per customer: Unless stated otherwise, trials are limited to one per organisation.

Promotional credits or discounts are time-limited and subject to the terms presented at the time of the offer. They have no cash value and cannot be exchanged or transferred unless we agree in writing.

7. Intellectual Property

The Services, including all software, user interfaces, databases, data compilations, designs, trademarks, and related materials, are owned by or licensed to Lead Reach Limited and protected by intellectual property laws.

  • Express Leads™ is a trademark and product of Lead Reach Limited. Other marks are the property of their respective owners.
  • License to you: Subject to these Terms and timely payment, we grant a limited, non-exclusive, non-transferable, revocable licence to access and use the Services for your internal business purposes.
  • Restrictions: You must not copy, modify, create derivative works of, reverse engineer, or resell the Services or any portion thereof except as expressly permitted by us in writing.
  • Feedback: If you provide feedback or suggestions, you grant us a perpetual, worldwide, royalty-free licence to use them for any purpose without obligation to you.

Nothing in these Terms transfers ownership of our intellectual property to you. All rights not expressly granted are reserved by us and our licensors.

8. User Content, Conduct & Acceptable Use

You are responsible for your data, lists, messages, and actions within the Services (“User Content”) and for complying with all applicable laws when using the platform.

Use the Services for lawful B2B prospecting and outreach; honour opt-outs; respect rate limits and fair use. Send unlawful spam, harvest addresses improperly, or use the Services for phishing, fraud, or harassment.
Follow applicable marketing and privacy laws (e.g., GDPR, UK PECR, CAN-SPAM, CCPA/CPRA) and your local rules. Upload malicious code, interfere with security, or attempt to access data you are not authorised to access.
Keep credentials confidential; promptly notify us of suspected unauthorised use or security incidents. Resell, sublicense, or redistribute platform data except as permitted for your internal business use.
Use accurate sender information and include required disclosures in outreach communications. Misrepresent your identity, spoof headers, or bypass opt-out/consent requirements.

By submitting or importing User Content, you grant us a non-exclusive, worldwide licence to host, process, and transmit that content solely to provide the Services to you and as otherwise permitted by law and our Privacy Notice.

We may suspend or terminate access for violations of this Section or any activity that, in our reasonable judgment, risks the security, integrity, or reputation of the Services or our users.

9. Confidentiality

Both parties agree to protect any non-public, confidential, or proprietary information disclosed during the course of the Services. Confidential Information includes business plans, customer lists, technical data, and any information marked or reasonably understood as confidential.

  • Your obligations: You agree not to disclose, copy, or use our Confidential Information except as necessary to use the Services.
  • Our obligations: We agree not to disclose your Confidential Information except as needed to deliver the Services, comply with the law, or with your consent.
  • Exclusions: Information is not confidential if it is publicly available, independently developed, or lawfully obtained from a third party without restriction.

  • Your responsibility: Your use of third-party services is governed by their own terms and policies. We are not responsible for third-party products or content.
  • Access & sharing: By enabling an integration, you authorise us to access and share relevant data with the third-party provider as necessary for the integration.
  • No endorsement: Reference to third-party services does not imply endorsement or guarantee of performance.

12. Availability & Service Levels

We aim to keep the Services reliable and available, but we do not guarantee uninterrupted or error-free operation. From time to time, we may perform maintenance or experience outages.

  • We disclaim all warranties, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
  • We do not warrant that the Services will be uninterrupted, error-free, completely secure, or free from harmful components.
  • We do not guarantee results from the use of the Services. Any business outcomes depend on your strategies, market conditions, and other factors outside our control.

Some jurisdictions do not allow exclusion of certain warranties, so some disclaimers may not apply to you. In those cases, our liability is limited to the minimum permitted by law.

14. Limitation of Liability

To the fullest extent permitted by law, in no event shall Lead Reach Limited, Express Leads, its affiliates, directors, employees, or licensors be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages.
  • Loss of profits, revenue, goodwill, data, or business opportunities.
  • Any damages exceeding the greater of (a) ÂŁ500 GBP or (b) the total amount you paid to us in the 12 months preceding the claim.

Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law, such as liability for death, personal injury, or fraud.

15. Indemnification

You agree to indemnify, defend, and hold harmless Lead Reach Limited (Express Leads), its affiliates, officers, employees, and partners from and against any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:

  • Your access to or use of the Services.
  • Your violation of these Terms or applicable laws.
  • Your User Content, including claims that it infringes third-party rights or breaches laws.
  • Any misuse of the Services by you or your organisation.

We reserve the right to assume exclusive defence of any matter otherwise subject to indemnification by you, in which case you will cooperate with us in asserting any available defences.

16. Termination

We may suspend or terminate your access to the Services immediately if:

  • You breach these Terms, misuse the Services, or violate applicable laws.
  • We are required to do so by law, regulation, or governmental order.
  • Your payment obligations remain unpaid after reasonable notice.
  • We discontinue the Services (with reasonable prior notice where possible).

Upon termination:

  • Your right to use the Services ceases immediately.
  • Outstanding fees remain payable.
  • Certain provisions survive termination, including confidentiality, intellectual property, limitations of liability, and indemnification.

You may terminate your account at any time by cancelling via the platform or contacting support. Termination does not entitle you to a refund unless required by law or expressly stated in writing.

These Terms and any disputes or claims (contractual or non-contractual) arising from or related to them shall be governed by and construed in accordance with the laws of England and Wales.

If you are located in another jurisdiction, mandatory consumer protection laws of your country may also apply to the extent required by law.

We aim to resolve disputes amicably. Please contact us first to attempt resolution before pursuing formal action. If a resolution cannot be reached:

  • Business users: Any dispute shall be subject to the exclusive jurisdiction of the courts of England and Wales.
  • Consumers (where applicable): You may have the right to bring a claim in your local courts under applicable law.
  • Alternative resolution: We may agree in writing to use arbitration or mediation as an alternative to court proceedings.

Nothing in this section limits your right to file a complaint with a competent regulatory authority.
